Terms of Service

1. Agreement to Terms

These Terms of Service (“Terms”) govern access to and use of LossStack One, LossStack Field, associated applications, portals, APIs, integrations, and services (collectively, the “Services”). By creating an account, accepting an order, or using the Services, you agree to these Terms.

2. Eligibility and Authority

You must be legally able to enter into these Terms. If you use the Services for an organization, you represent that you are authorized to bind it and that it is responsible for its users' use of the Services.

3. LossStack Services

LossStack provides software for claim and field operations, including documentation, inspections, photos, measurements, dispatch, contents, restoration, reports, communications, signatures, portals, and AI-assisted workflows. Features vary by plan, device, geography, and availability.

4. Accounts and Organizations

You must provide accurate account information, safeguard credentials, maintain current contact information, and promptly report suspected compromise. Each organization is responsible for its configuration, users, permissions, and activity.

5. Authorized Users

Only authorized users may access an organization's workspace. You may not share credentials outside authorized use or permit access that exceeds a person's role. Administrators are responsible for adding, removing, and managing users.

6. Customer Data

Customer Data includes information and content submitted to or generated through customer use of the Services, including claim, property, contact, inspection, photo, document, message, and report information. Customers are responsible for its lawfulness, accuracy, and the permissions needed to submit it.

7. Data Ownership

As between the parties, the customer owns Customer Data. LossStack owns the Services, software, code, designs, technology, workflows, underlying models where applicable, trademarks, and other platform intellectual property.

8. License to Process Customer Data

The customer grants LossStack a non-exclusive license to host, copy, process, transmit, display, and otherwise use Customer Data only as reasonably necessary to provide, secure, support, and improve the Services, fulfill customer instructions, and comply with law.

9. Photos, Documents, Inspections, Measurements, and Other Evidence

Customers remain responsible for verifying that evidence and measurements are complete, accurate, lawfully collected, and suitable for their intended use. Results depend on source information, device capabilities, field conditions, user input, and available data.

10. AI-Assisted Features

AI-assisted features provide help with narratives, summaries, classification, extraction, recommendations, and other tasks. Outputs may be inaccurate or incomplete and are not a substitute for professional judgment. Users must review outputs before relying on them.

11. Electronic Signatures and LossStack Sign

Customers are responsible for selecting appropriate documents, signers, disclosures, and signature workflows and for determining whether electronic signatures satisfy their legal or business requirements. LossStack does not determine a document's enforceability.

12. Client Portal and External Participants

Customers control invitations and information made available to clients and external participants. Customers must use appropriate recipients and promptly revoke access when no longer needed. Portal access does not grant unrestricted workspace access.

13. Mobile and Field Services

Mobile features may rely on network access, device permissions, cameras, LiDAR, GPS, or other hardware. Users must operate devices safely, obtain required permissions, and comply with workplace, property-access, and recording laws.

14. Third-Party Services and Integrations

Third-party services are governed by their own terms and may change or become unavailable. LossStack is not responsible for third-party products, but may exchange Customer Data with an integration when a customer enables or directs that connection.

15. Acceptable Use

Use the Services only for lawful, authorized business purposes and in accordance with documentation, plan limits, and applicable professional obligations. Do not interfere with another customer or the security or operation of the Services.

16. Prohibited Uses

  • Unauthorized access, credential sharing, scraping, reverse engineering, or circumvention of controls.
  • Malicious activity, destructive or unauthorized security testing, service degradation, or abusive automation.
  • Unlawful, fraudulent, infringing, deceptive, harmful, or unauthorized uploads or communications.
  • Use that violates privacy, recording, export, sanctions, insurance, professional, or other applicable laws.

17. Subscription, Fees, Billing, and Taxes

Customers must pay the fees and applicable taxes stated at purchase or in an order form. Recurring subscriptions renew and are billed according to the selected plan and disclosed billing cycle unless canceled under the applicable purchase terms.

18. Trials and Promotional Access

Trials, credits, previews, and promotional access may be limited, changed, or ended as described when offered. Unless expressly stated, they do not create a commitment to provide a paid feature or future service.

19. Cancellation and Termination

Customers may cancel according to the applicable account or order process. LossStack may suspend or terminate access for material breach, abuse, security threats, nonpayment, legal requirements, or conduct that risks harm to customers, third parties, or the Services.

20. Data Following Termination

After termination, access may end and Customer Data may be deleted according to applicable retention practices, legal requirements, and written agreements. Customers should export needed information before access ends. Backup deletion may follow normal cycles.

21. Intellectual Property

The Services and all related platform materials are protected by intellectual-property laws. Except for the limited right to use the Services during an authorized subscription, no rights are granted in LossStack technology or branding.

22. Feedback

If you provide ideas or feedback, you grant LossStack a perpetual, irrevocable, worldwide right to use it without restriction or compensation, provided LossStack does not identify you publicly without permission.

23. Confidentiality

Each party will use reasonable care to protect nonpublic information received from the other and use it only for the relationship, except where disclosure is authorized, legally required, or the information is independently public or lawfully obtained.

24. Security Responsibilities

LossStack maintains safeguards appropriate to the Services. Customers remain responsible for user access, device security, credentials, lawful data handling, integrations, and promptly notifying LossStack of suspected unauthorized access.

25. Availability and Changes to the Service

The Services may experience maintenance, interruptions, or changes. LossStack may modify or discontinue features while seeking to avoid unreasonable disruption. These Terms do not create an uptime service-level agreement.

26. Beta, Preview, and Roadmap Features

Beta, preview, research, roadmap, and planned capabilities may be incomplete, change without notice, or never be released. They are not guaranteed release commitments and should not be relied on for purchasing or operational deadlines.

27. Disclaimers

To the maximum extent permitted by law, the Services are provided “as is” and “as available.” LossStack disclaims implied warranties, including merchantability, fitness for a particular purpose, title, and non-infringement, except where a written agreement expressly provides otherwise.

28. Insurance / Claims Disclaimer

LossStack is software—not an insurance company, carrier, adjusting firm, law firm, engineering firm, accounting firm, or other professional advisor. LossStack does not make coverage decisions or guarantee acceptance of reports, measurements, narratives, estimates, weather or property information, or other material by any carrier, court, appraiser, contractor, agency, or third party.

29. Professional Advice Disclaimer

The Services do not provide legal, engineering, accounting, safety, coverage, estimating, appraisal, or other professional advice. Users remain responsible for review before professional, financial, contractual, legal, safety, estimating, coverage, or claim decisions.

30. Limitation of Liability

To the maximum extent permitted by law, LossStack will not be liable for indirect, incidental, special, exemplary, punitive, or consequential damages, or lost profits, revenue, data, or business. Total liability is limited to fees paid for the Services during the three months before the event giving rise to the claim, except where such a limitation is prohibited.

31. Indemnification

You will defend and indemnify LossStack from third-party claims arising from your Customer Data, unlawful or unauthorized use, violation of these Terms, infringement, or violation of another person's rights, to the extent permitted by law.

32. Governing Law and Disputes

Any governing-law or venue provision in an applicable signed order or written agreement controls. Otherwise, governing law and venue will be determined under applicable law. Before filing a formal claim, the parties should attempt in good faith to resolve the dispute through written notice.

33. Changes to These Terms

LossStack may update these Terms as the Services or laws change. The updated Terms will state their effective date, and additional notice will be provided when required. Continued use after the effective date constitutes acceptance where permitted by law.

34. General Provisions

These Terms and applicable orders form the agreement concerning the Services. If one provision is unenforceable, the remainder continues. Failure to enforce a provision is not a waiver. You may not assign these Terms without consent; LossStack may assign them as part of a business transaction or reorganization.
